PROPOSED RESOLUTION 2023-R-04 IS A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF PEMBROKE PINES, FLORIDA, VACATING THE FIFTEEN FOOT (15') UTILITY EASEMENT ALONG THE WEST EDGE OF MINNAUGH PLAT, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A", PROVIDING FOR RECORDATION; PROVIDING FOR CONFLICTS' PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.

 

Summary Explanation and Background

 

 

SUMMARY EXPLANATION AND BACKGROUND:

1. Franklin Academy is expanding to the east and adding additional parking and vehicle queuing lanes. During the platting process a fifteen foot (15') utility easement was dedicated as a part of the Minnaugh Plat along the western edge as recorded in Plat Book 164, Page 25 of the Broward County Records.

 

2. The current property owner is requesting the City vacate this fifteen foot (15') utility easement in order to construct certain improvements.

 

3. The City has reviewed letters submitted by all utility companies indicating no objection to the vacation of this fifteen foot (15') utility easement.

 

4. The City has not installed facilities in the utility easement.

 

5. The Public Services, Engineering Division recommends adoption of Proposed Resolution No. 2023-R-04.
