MOTION TO RATIFY THE CITY MANAGER'S APPROVAL FOR C. DAVIS ELECTRIC CO., INC. TO PERFORM AN EMERGENCY REPAIR DUE TO AN ELECTRICAL FIRE AT PEMBROKE SHORES PARK IN AN AMOUNT NOT TO EXCEED $205,000, PURSUANT TO SECTION 35.18(C)(1) OF THE CITY'S CODE OF ORDINANCES.

PROCUREMENT PROCESS TAKEN:

 

- Chapter 35 of the City’s Code of Ordinance is titled “PROCUREMENT PROCEDURES, PUBLIC FUNDS.”

 

- Section 35.18 of the City’s Code of Ordinances is titled “COMPETITIVE BIDDING OR COMPETITIVE PROPOSALS REQUIRED; EXCEPTIONS.”

 

- Section 35.18(C) states that “Only the following situations are exempt from the competitive bid and competitive proposal requirements of this section:”

 

- Section 35.18(C)(1) states, “Emergency purchases. In urgent cases of compelling emergency that require the immediate purchase of commodities or services, the City Manager is empowered to waive competitive bidding or competitive proposals and authorize the Chief Procurement Officer to secure by open market procedure any commodities or services, notwithstanding the estimated cost of the commodities or services.”

 

- Section 35.21 of the City's Code of Ordinances is titled "AWARD OF CONTRACT."

 

- Section 35.21(A) of the City's Code of Ordinances is titled "City Commission approval."

 

- Section 35.21(A)(1) states, “An initial purchase of, or contract for, commodities or services, in excess of $25,000, shall require the approval of the City Commission, regardless of whether the competitive bidding or competitive proposal procedures were followed.”

 

 

SUMMARY EXPLANATION AND BACKGROUND:

 

1.  On April 15, 2023, the Pembroke Shores Park experienced an electrical fire with loss of power to the south fields (5,6,7,8), south concession, optimist clubhouse, police officer trailer, and the FSU Annex building.

 

2.  A generator was set up to power the officer’s home and the FSU Annex Bldg.

 

3.  On April 17, 2023 C Davis Electric Co. was called in to evaluate the conditions along with in-house staff.

 

4.  On April 20, 2023, Staff solicited and obtained a quote in the amount of $205,000 from  C Davis Electric  Co., for the following repairs:

 

Removal of one 800 amp MDP.

Removal of existing parallel feeders from FP&L.

Installation of one temporary 800 amp Disconnect.

Installation of one Line Gutter off disconnect.

Installation of one 600 amp Temp panel with new breakers.

Installation of one new 200 amp temp panel with new breakers.

Pull in new feeder wiring from FP&L transformer to new temp 800 amp disconnect.

Installation of one new brooks box and cut back wiring for panel DP3 and two feeds for transformers.

Installation of new wiring from 600 amp and 200 amp panel over to new brooks box as needed.

Price includes C Davis taking all old components with them including but not limited to scrap wire.

Provision and installation of new 800 amp disconnect, 600 amp and 200 amp can guts and covers once they arrive, approx. 100 Business days after submittals are approved.

FP&L shutdown will be needed and to be performed during normal business hours to reduce additional fees FP&L would charge for OT shutdowns.

Price includes engineering fees. Will be credited if fees are not needed. $5,000.00

Price includes permit fees.

Feeders for DP3 and Transformers to Be high pressed in Brooks box. If failure occurs C Davis will provide replacement High Press Connections under warranty

 

5.  Staff contacted the City Manager and requested his approval of an emergency purchase, pursuant to section 35.18(C)(1) of the City's Code of Ordinances, which he granted.

 

6.  Staff recommends City Commission ratification of the City Manager's approval for C. Davis Electric Co., Inc. to perform an emergency repair due to an electrical fire at Pembroke Shores Park in an amount not to exceed $205,000, pursuant to Section 35.18(C)(1) of the City's Code of Ordinances.
