PROPOSED RESOLUTION 2024-R-14 IS A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF PEMBROKE PINES, FLORIDA APPROVING AND AUTHORIZING THE EXECUTION AND RECORDING OF A DECLARATION OF RESTRICTIVE COVENANT PROHIBITING INCINERATORS OR ANCILLARY USES ON THE PROPERTIES LOCATED AT SW 54th PLACE, SOUTHWEST RANCHES, FL 33332 AND 20710 SW 54th PLACE, SOUTHWEST RANCHES, FL 33332 WITH FOLIO NUMBERS 503935010141, 503935010150, AND 503935120010 AND DIRECTING THE APPROPRIATE CITY OFFICIALS TO TAKE ANY AND ALL ACTION NECESSARY TO EFFECTUATE THE INTENT OF THIS RESOLUTION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY AND PROVIDING FOR AN EFFECTIVE DATE.

SUMMARY EXPLANATION AND BACKGROUND:
1. The City of Pembroke Pines (“City”) owns the properties located at SW 54th Place, Southwest Ranches, FL 33332 and 20710 SW 54th Place, Southwest Ranches, FL 33332 with Folio Numbers 503935010141, 503935010150, and 503935120010 (“Properties”).
2. The City Commission wishes to restrict the Properties by prohibiting incinerator and related uses.
3. The City Commission finds it to be in the best interests of the health, safety, and welfare of the citizens and residents of the City to execute and record the Declaration of Restrictive Covenant, attached hereto as Exhibit “A”.
4. The City Commission hereby approves and authorizes the execution and recording of the Declaration of Restrictive Covenants, attached hereto as Exhibit “A”, prohibiting incinerator and ancillary uses on the properties located at SW 54th Place, Southwest Ranches, FL 33332 and 20710 SW 54th Place, Southwest Ranches, FL 33332 with Folio Numbers 503935010141, 503935010150, and 503935120010.
5. The appropriate City officials are hereby authorized and directed to take any and all action necessary to effectuate the intent of this Resolution.
